We (“HornOK Ecommerce Private Limited” or “Company”, “we”, or
“us”) collect information about you when you use our mobile
application(HornOK, HornOK driver, Fleet partner), website and
services (collectively, the ‘Services’). This Privacy Policy
explains how we collect, process, use, share and protect
information about you. It also tells you how you can access and
update your information and make certain choices about how your
information is used.
The Privacy Policy covers both “online services” (e.g., web and
mobile services, including any websites operated by us or Mobile
Application, accessed through personal computers, mobile devices
or otherwise) and “offline services” (e.g., collection of data
through mails, telephone, or in person) activities owned,
operated, provided, or made available by the Company. The Privacy
Policy does not apply to information we collect from or about
drivers, couriers, partner transportation companies, or any other
persons who use the our platform under license (collectively
“Drivers”) BY ACCEPTING THE CUSTOMER TERMS AND CONDITIONS, YOU
AGREE TO THE TERMS OF THIS PRIVACY POLICY. Please review the
following carefully so that you understand our privacy practices.
If you do not agree to this Privacy Policy, do not accept the
Customer Terms and Conditions or use our Services. This Privacy
Policy is incorporated by reference into the Customer Terms and
Conditions.
INFORMATION YOU PROVIDE TO US:
We collect information you provide directly to us, such as when
you create or modify your account, request on-demand services,
contact customer support, or otherwise communicate with us. This
information we collect may include: name, email, phone number,
postal address, profile picture, payment method, and other
information you choose to provide..
INFORMATION WE COLLECT WHEN YOU ACCESS OR USE OUR
SERVICES:
We also collect certain information in addition to the information
you provide to us when you use our Services. We collect
information about you in the following general categories: Call
and SMS Data: Our Services facilitate communications between Users
and Drivers and in connection with this Service we receive call
data, including date and time of the call or SMS message, the
Users’ phone numbers, and the SMS message content. Contacts
Information: If you permit the HornOK application to access the
contacts on your device, we may access information from your
contacts to facilitate social interactions (e.g. for sharing the
travel information with any other person on your contacts, etc.)
through our Services and for other purposes described in this
Policy. Device Information: We may collect information about your
mobile device, including, for example, the hardware model,
operating system and version, software and file names and
versions, preferred language, unique device identifier,
advertising identifiers, serial number, device motion information,
and mobile network information. Location Information: When you use
the Services for transportation, we collect the location data
about the trip from the HornOK application used by the Driver. If
you permit the application to access location services through
your mobile operating system (“platform”), we may also collect the
location of your device when the application is running in the
foreground or background. Transaction Information: We collect
transaction details related to your use of our Services, including
the type of service requested, date and time the service was
provided, amount charged, distance traveled, and other related
transaction details. Usage and Preference Information: We collect
information about how you and site visitors interact with our
Services, preferences expressed, and settings chosen. The Usage
Information we acquire may include the browser that you are using,
the URL that referred you to our Services and any other general
information including date and time among other information. Usage
information may be collected using a cookie. If you do not want
information to be collected using a cookie, your browser allows
you to deny the such permissions. If you choose to disable cookies
on your device, some features of your Services may not function
properly or be able to deliver customized information to you. We
are not responsible for use of cookies by third party and The
Privacy Policy does not cover use of third party cookies. Log
Information: We collect server logs when you interact with our
Services, which may include information like device IP address,
access dates and times, application features, pages viewed,
application crashes and other system activities, type of browser,
and the third-party site or service you were using before
interacting with our Services.
INFORMATION WE COLLECT FROM OTHER SOURCES:
We may obtain information from other sources and combine it with
the information received from our Services.
FOR EXAMPLE:
When you choose to link, or log in to your HornOK account with a
payment provider or social media service. When you opt for on
demand services, our Drivers may provide us with a User rating
after providing services to you. When you interact with our
Services in any other capacity apart from a user, for instance as
a Driver, then we may combine that information with information we
have collected from you in your capacity as a User or rider.
WE MAY USE THE INFORMATION WE COLLECT ABOUT YOU:
For personalizing the Services by monitoring which features of the
Services are used most, including usage patterns, geographic
locations to determine where best to implement our Services and
where to improve our Services; We will also use the information by
facilitating payment, sending receipts, providing Services you
request for, developing new features including new safety
features, providing customer support, authenticating users,
sending product updates; For developing statistics and data with
regard to improving the security of the application, developing
the precision of the location data and other similar features;
resolving software bugs, operational problems, application
crashes; testing, research and analysis of data; internal business
purposes; For improving the communication between the User and the
Driver where information like geo-location, contact information is
provided to the Driver or the companies for which the Drivers
work, whereby (i) Drivers may communicate with you for providing
Service of transportation (ii) Drivers can maintain the Estimated
Time of Arrival (iii) Drivers can identify the pick-up location
and drop location (iv) the Users can track the Drivers and the
distance of the vehicle (v) usage of certain features like
referrals, invites, car-pooling, split fare requests; For sending
important notifications like changes in fare rates, inclusion of
any new feature, special offers or promotional materials,
intimation of any contest, targeted advertising (We may use your
information collected from website or mobile application to
display advertisement relevant to your web searches or previous
usage).
WE MAY SHARE THE INFORMATION COLLECTED BY US ABOUT YOU
WITH:
Drivers or companies for which Drivers work to enable them to
provide the Service requested by you and this includes information
like your name, photo, pick-up location and drop location, contact
information, ratings of Users by Drivers; Third Parties who are in
collaboration with us or whose Services you have requested through
an option and this includes payment options from vendors like
Paytm or shopping partners and any United Payment Interfaces,
promotional offerings made by any third party or us, coupons
generated by any third party in collaboration with us, Third Party
applications which integrate with our API/ Services or vice versa.
We are not responsible for the privacy policies and practices of
such third parties whose services you have requested or agreed
upon. General public, if any information is submitted in a public
forum and includes features of our Services that are viewable by
the general public, blog posts or comments, social media posts,
feedbacks and reviews posted in medium viewable by general public.
Affiliated entities and subsidiaries that provide support to our
Services, conduct data processing, data centralization, logistics,
provide technological infrastructure, maintenance services,
database management, web analytics and any such services;
Co-branded services that may be provided to you in association
with third parties and includes sponsors and charities. If you
choose to register for products and/ or services through
Co-Branded Services then it shall be deemed or shall automatically
mean your consent to provide information to both us and the third
party;Government authorities, law enforcement officials and third
parties to enforce and comply with the law, regulation or any
legal process, (i) if your actions are inconsistent with our User
agreement or Terms of Service and any other policies (ii) to
protect and/ or defend rights, property or safety of our Company
or any third party; (ii) if any investigation of potential
violations exits (iii) if any fraud, security or technical issues
are detected (iv) to prevent any activity which we may consider to
be or to pose a risk of being illegal, unethical and/ or legally
actionable; Entities or Companies in connection with any merger or
during negotiations, sale of company assets, restructuring or
consolidation, financing, acquisition of all or a portion of the
business by or into another company; Any other entities or third
parties if we notify you and you consent to the sharing;We may
also share your information in aggregated and/ or by protecting
your anonymity which cannot reasonably be used to identify you.
SHARING OF INFORMATION VIA SOCIAL MEDIA OR OTHER
APPLICATIONS:
Our mobile and online Services may include social media features
and other related tools which let you share information and
actions which are made on our Services with other applications,
sites, social media and vice versa. This sharing feature allows
sharing of information with friends or general public according to
your preference as set in the third party application, site or
social media. Please refer to the privacy policy of those
applications, site or social medias to either allow or deny
sharing of information.
You may modify, cancel or delete information about you any time
through the HornOK application or by contacting us via email
address mentioned in the mobile application. We will comply with
request for modification, cancellation or deletion of personal
information about you in accordance with the applicable law as
soon as reasonably practicable. Please note that you are
responsible for maintaining the accuracy and extent of the
information you divulge or submit to us, including but not limited
to your contact information which we use to provide hassle free
services.Account Information can be amended at any time by logging
into the mobile application. Please note that certain information
about you will be retained by us for purposes required by law or
for business purpose to the extent permitted by law. In cases of
pending debt in your account or any dispute therewith or if we
believe any act of fraud or any terms having been violated, then
we will first resort to solving the issue before deleting your
account. Location Information can be provided upon request every
time you log into our application. We request that such permission
be allowed so that we can collect precise location from your
device for a hassle free service of transportation. If despite
this if you wish to not allow location information or change your
settings you can do so by switching off you GPS/GLONASS service
from your mobile settings. Contact Information permissions can be
provided by you when you first log into our mobile application. We
require this to contact you for providing services including but
not limited to the ability of the driver to contact you for pick
up purposes. We request you to keep this information updated so
that we can contact you whenever you avail our services. Access
Rights are according to the permissions that are granted and
amount of information or changes to information that are provided
to us. If the access is limited to certain aspects of the mobile
application then it will be difficult for us to permit access to
those features in connection with that particular aspect.
Additionally, if inaccurate information or information which is
false is provided to us then we will be forced to terminate your
access to our Services.
Information you provide to us and information that we collect are
securely stored in our servers and database which use standard,
commercially viable security practices like encryptions,
firewalls, etc., to keep your information safe. However, we cannot
guarantee security of our databases if they are interception while
being transmitted to us over the internet or wireless
communication as no security system is impenetrable.
CHANGES TO THE PRIVACY POLICY:
Information you provide to us and information that we collect are

commercially viable security practices like encryptions,
firewalls, etc., to keep your information safe. However, we cannot
